Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kasa web application (the "Service"), operated by Kaushal Jain, an individual ("Kasa," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and that you have the legal capacity to enter into these Terms. We may suspend accounts that we reasonably believe belong to someone under 18.

2. Your Account

• You sign in using Google Sign-In. You are responsible for maintaining the security of the Google account linked to your Kasa account.
• You agree to provide accurate information and to keep it up to date.
• You are responsible for all activity that occurs through your account.
• Notify us immediately at thekasacommunity@gmail.com if you suspect unauthorized access to your account.

3. Description of the Service

Kasa provides real-time collaboration tools including video/audio calling, group rooms, live chat, a shared whiteboard, code/document collaboration, and related social features (following, friend requests, direct messages). Some features rely on peer-to-peer WebRTC connections between users' devices (with an encrypted relay server used only where a direct connection is not possible); we do not record, store, or have access to the audio/video content of calls. Other participants in a room or call can see your network (IP) address and anything you choose to share there, and may keep their own copies of it.

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Upload, share, or transmit content that is unlawful, defamatory, obscene, pornographic, harassing, hateful, or discriminatory
• Infringe any third party's intellectual property, privacy, or other legal rights
• Impersonate any person or entity, or misrepresent your affiliation
• Harass, threaten, bully, stalk, or abuse other users
• Upload viruses, malware, or attempt to disrupt, hack, or gain unauthorized access to the Service, other users' accounts, or our infrastructure (including attempting to bypass authentication, security rules, or rate limits)
• Send unsolicited bulk messages, spam, or abuse the notification system
• Use the Service to violate any applicable local, state, national, or international law, including India's Information Technology Act, 2000 and rules made thereunder
• Share content depicting child sexual abuse material, non-consensual intimate imagery, or content that threatens the sovereignty, integrity, defence, security, or public order of any nation

We reserve the right to investigate and take appropriate action, including content removal, account suspension, or termination, and reporting to law enforcement, for any violation of this policy.

5. Your Content

You retain ownership of any content you create or share through the Service (messages, whiteboard drawings, files, etc.). By submitting content, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, and display that content solely as necessary to operate and provide the Service to you and the users you share it with. This license ends when your content is deleted from the Service, except where retention is required for legal or security purposes (see our Privacy Policy).

You are solely responsible for the content you share and confirm you have the necessary rights to share it.

6. Content Moderation, Reporting, and Takedowns

We provide mechanisms to report abusive users and content. Upon receiving a valid complaint or a court/government order regarding unlawful content, we will act in accordance with applicable law, including removing or disabling access to such content:

• Within 36 hours of a court order or notification by an appropriate government agency, as required under India's IT Rules, 2021
• Within 24 hours for complaints regarding content specifically depicting an individual in a sexually explicit or nude context, or impersonation, where such content is reported by the affected individual
• Within a reasonable time for other valid complaints under our standard grievance process (see Section 13)

We may also proactively remove content or suspend accounts that we reasonably believe violate these Terms, without prior notice.

7. Intellectual Property

The Service, including its design, software, trademarks ("Kasa" and associated logos), and underlying technology, is owned by Kaushal Jain and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks or proprietary technology beyond what is necessary to use the Service as intended.

All source code, markup, styles, designs, text, and other materials that make up the Service are protected by copyright and are proprietary. Without our prior written permission, you must not: (a) copy, clone, mirror, scrape, re-host, or redistribute the Service or any substantial part of it; (b) use its code or design in another product or service; (c) decompile, de-obfuscate, or reverse-engineer it to create a copy or a competing service; (d) remove or alter any copyright notice, watermark, or identifying mark; or (e) use the "Kasa" name or branding in a way that suggests a copy is the original. The Service contains identifying marks that allow unauthorised copies to be traced. We may take action against violations, including takedown requests to hosting providers and legal proceedings.

8. Third-Party Services

The Service relies on third-party infrastructure providers, including Google (Firebase Authentication, Realtime Database, Cloud Messaging, reCAPTCHA, YouTube embeds), Vercel (hosting), Metered (relay servers), Sentry (error monitoring), and WebRTC/PeerJS signaling services, to operate. Your use of the Service is also subject to those providers' own terms where applicable (e.g., Google's Terms of Service for sign-in). We are not responsible for the availability or performance of third-party infrastructure outside our control.

9. Calls and Recording

Kasa does not record or store audio/video calls. If call recording is added as a feature in the future, we will require and technically enforce all-party consent before any recording begins, consistent with applicable wiretapping and consent laws (which vary by jurisdiction, including two-party consent requirements in certain regions).

10. Termination

You may stop using the Service and delete your account at any time using the in-app Delete Account link, or by contacting thekasacommunity@gmail.com. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or pose a risk to other users or the Service.

11. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Kaushal Jain and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the fees you paid us in the 12 months before the claim or, because the Service is currently free, INR 5,000 (about US$60), whichever is greater.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable law (including certain consumer-protection laws in India, the EU, and elsewhere).

13. Grievance Redressal (India)

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, grievances regarding content on the Service may be directed to our Grievance Officer:

Complaints will be acknowledged within 24 hours and resolved within the timeframe prescribed by applicable rules.

14. Indemnification

You agree to indemnify and hold harmless Kaushal Jain from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your content, or your misuse of the Service.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights you may have in your own country, any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India having territorial jurisdiction over the place where Kaushal Jain resides.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by other reasonable means, with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Miscellaneous

• Severability — if any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• Entire agreement — these Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• No waiver — our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment — you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
